Terms are Net Ten Days. While split billing can be provided, both attorneys are jointly responsible. Failure to pay within 60 days of an invoice, and MiADR Center may seek collection from clients as well as from Attorneys.
Any objections to billing must be in writing and within ten days of the date of email being emailed.
If BOTH attorneys do not want to be responsible for fees, may have BOTH of their clients purchase package(s) cour couples and may attend.
Drafting of Orders / Agreements / Judgments:
MiADR Center recommends documents be drafted and signed when all parties are present so there is no buyers remorse where the parties may back out of the agreement. MiADR will draft at our hourly rate.
Conflict:
Facilitators are prohibited from representing either party in a case they mediate a case for. This means your client can’t fire you and hire an attorney from MiADR that worked on your case. A conflict is created once there is any mediation with the two parties as to the case they mediate.
Briefs / Summary:
A list of issues to be mediated is required, and Brief / Summaries are options, and the parties are charged as a group for review time. Brief / Summaries must be provided no later than 72 hours before the mediation session.
No Brief / Summary are allowed if attending where the clients have purchased couples package(s).
No Attorney Option:
Sometimes attorneys (or parties) think mediation would be better if the attorneys are not present. This option is ONLY available if both attorneys make a written request for the same.
If a couple makes the request for no attorney mediation (they come to us), they will be directed to contact their attorneys to set up a mediation with their attorneys present. We do not do mediation on cases where only one side is represented. If mediation is desired and only one party is represented, that attorney may request MiADR to mediate some or all issues without them present, but that request again needs to be in writing by the attorney.
Non-Attorney options require the parties to purchase a package for couples.
